IPA Requests DOL Amicus Filing in Anderson v. Intel

On February 10, the IPA formally asked the U.S. Department of Labor to submit an amicus brief in Anderson v. Intel Corp., now pending before the Supreme Court.

The case addresses whether ERISA plaintiffs alleging fiduciary imprudence must identify a meaningful benchmark when claiming relative underperformance. The Court’s decision could shape how fiduciary conduct is evaluated in future litigation, particularly in cases involving comparisons across differing investment strategies.

In its request, IPA encouraged the Department to reaffirm that ERISA’s prudence standard is grounded in a fiduciary’s process and that performance-based claims should be evaluated against reasonably comparable alternatives.
